This document provides the basis for the legal relationship between Spyder Enterprises Inc, "Spyder Enterprises", and it's customers.

This document is intended to provide a general understanding of what Spyder Enterprises considers inappropriate activity on the part of its subscribers. The following are some, not necessarily all, contributing factors to the policies outlined below:

• conformance with existing law

• ability to provide a reliable, quality driven service to our subscribers

• protection of our reputation as an Internet Service Provider

All relationships with Spyder Enterprises are "at will". This means that that you, or Spyder Enterprises may terminate that relationship at any time, with or without cause. In some cases penalties may be involved.

Spyder Enterprises will be the sole and final judge of what constitutes a violation of this, or any, policy.

Spyder Enterprises does not undertake or assume any responsibility to screen activity or actively view contents of e-mail or individual Web server files or pointers. Spyder Enterprises' function is to receive, process, store, forward, and transmit information without regard to content.

It is our intention to allow Spyder Enterprises subscribers full access to everything that the Internet has to offer with minimal or no interference. Our support of free speech is paramount in the creation of this document. However, certain activities are considered inappropriate on the Internet. Our goal is to provide this document as a guide to our views on what constitutes inappropriate use of Spyder Enterprises services and to inform our subscribers of the actions we may take, with or without notice, in the event that we become aware of inappropriate use of Spyder Enterprises services.

There are Internet sites which contain materials deemed unfit for viewing by minors under the age of 18. Some sites contain materials in graphical and/or text form that may be considered obscene or harmful. Subscribers are cautioned that Spyder Enterprises is not responsible for the content of these sites and has no control over them. Subscribers agree to hold Spyder Enterprises harmless in regard to site containing materials which could be considered obscene, lewd, offensive, and/or harmful. It is the policy of Spyder Enterprises that subscribers are responsible for their own viewing habits and additionally responsible for any minors using their account. We do not filter or screen postings or sites on the Internet. There are tools available to screen the content of the Internet such as NetNanny, SurfWatch, and KinderGuard. We believe these choices should be left up to the individual.

 

Our Usenet Posting Policy

The following are some of the activities that are considered inappropriate and are grounds for termination of service:

•Posting to newsgroups under a fictitious or forged e-mail address.

•Unauthorized commercial postings to restricted newsgroups.

•Chain letters are forbidden.

•Posting inappropriate articles to newsgroups.

•Posting articles to an inappropriate number of newsgroups.

•Violation of the FAQ for the particular newsgroup.

•Disregard of moderators request in moderated groups.

This is a matter of the culture of the Internet and, as such, as a subscriber, you are invited to read Usenet articles regarding the subject to learn what is appropriate. An excellent place to start is the newsgroup news.announce.newusers. It is our intent to uphold the standards of Usenet.

 

E-mail Policy

The following activities are considered inappropriate and are grounds for termination of service:

•Posting e-mail under a fictitious or forged e-mail address.

•Sending large amounts of unsolicited e-mail to individuals or organizations.

•Sending unsolicited, threatening or harassing (in our opinion) e-mail to other persons or organizations or groups after being requested by those entities to stop.

•Using any Spyder Enterprises resource to disguise or obscure yourself or place of connection to the Internet or origination point of a message or act.

•Use any resource of Spyder Enterprises to relay mail from another location

YOU MAY NOT USE ANY RESOURCES OF SPYDER ENTERPRISES INC. TO SUPPORT ANY ACTIVITY OF BULK EMAIL OF ANY FORM.

Account Usage Policy for Individual Dial-up PPP and Individual Dial-up ISDN Service

Connections to Spyder Enterprises equipment will be automatically disconnected after a period of inactivity. Inactivity is defined as a period of time in which no activity is detected by Spyder Enterprises equipment through electronic, or other, means and the account is not being actively used. Any electronic or mechanical means utilized to circumvent an inactivity disconnect may result in termination of service. Electronic and mechanical means include, but are not limited to: pinging the mail server, using electronic or software dialers which maintain an active connection, using an e-mail program to automatically check mail.

The following are some of the activities that are considered inappropriate use with Spyder Enterprises Individual Dial-up PPP and Dial-up ISDN accounts and are grounds for termination of service:

•Accounts are for one connection only. Only one simultaneous connection per user is allowed.

•Accounts are for interactive use only. Bots or cron jobs are not permitted to keep your connection established.

•Running of servers over dial-up connections is prohibited. PPP accounts may not be used as a commercial avenue or connection for a dedicated server site to the Internet.

•Sharing of accounts is prohibited except for immediate family members sharing a single computer. Immediate family is defined as the spouse or children of the account holder and whom all must live at the same address.

•Re-selling service without express written consent of Spyder Enterprises is prohibited.

•Over utilization, in our judgment, of time, bandwidth or disk space is prohibited.

•Late payment of fees due is grounds for suspension or termination of service.

•Accounts with multiple mailboxes are subject to all of the restrictions above. Additional mailboxes are provided as a means for more than one individual to retrieve mail with the same dial-up account. This is appropriate when there is only one computer used for the dial-up connection. It is not appropriate for multiple people on multiple computers.

If Spyder Enterprises becomes aware that any of its subscribers have participated in any of the above, we reserve the right to terminate service without notice. However, our preferred course of action is to advise the user of the infraction and request it not be repeated.

In the event a subscriber's access is temporarily deactivated as a result of any of the above activities, the account may be subject to a reactivation charges and/or deposit. Requirements to be determined by Spyder Enterprises.

Please remember that your service fee for your individual account does not convey the cost of a single phone line. We want you to use our service but please remember that others do to. Our service is kind of like an "All you can eat" offer at some restaurants. You can come in and pay a single price to eat all you want. You can not arrive when the doors open and eat all day and all evening. If we allowed this with our service you would have to find another service provider because we would be out of business. No one likes busy signals, you don't, and neither do others. We will monitor our phone line usage and add more line as they are needed. If you have long periods of busy signals please let us know. THIS IS ONE OF OUR FIRST CUSTOMER SERVICES CONCERNS !

 

World Wide Web Services Policy

With the World Wide Web services, Spyder Enterprises provides a platform for our customers to publish and make information available to the World Wide Web. Under this service the address of our customers World Wide Web page generally contains the address of Spyder Enterprises World Wide Web page and thereby significantly associates the customers information with Spyder Enterprises service. Spyder Enterprises reserves the right to remove any information which, in our opinion, is offensive or sexually explicit. A useful guideline is for the content of your web site to be no more than what you would see in a PG13 rated movie.

This policy in no way obligates Spyder Enterprises to monitor or filter the information placed on it's world wide web servers. As previously stated in this policy, it is Spyder Enterprises' policy to NOT monitor this information. We merely request that our customers stay within the aforementioned guidelines.

 

Privacy Policy

Spyder Enterprises function is to receive, process, store, forward, and transmit information without regard to content. If, however, Spyder Enterprises becomes aware of any activity which in the opinion of Spyder Enterprises staff is in violation or may violate any statute, governmental rule, ordinance or judicial decision, Spyder Enterprises may forward said questionable information to an appropriate law enforcement or regulatory agency. This may be done with or without notice to the subscriber. Spyder Enterprises will not release any subscriber's information without lawful process being followed, unless the law allows for such production without process. Where the law requires notice, Spyder Enterprises will provide such notice, or verify that notice has been given by appropriate authorities prior to or after production, as appropriate.

Spyder Enterprises considers the right to privacy a very important right for our subscribers. Spyder Enterprises views any attempt to read, modify, or otherwise use another person's private e-mail without permission as a very serious privacy violation.

On occasion, it may become necessary for Spyder Enterprises employees to examine system logs and other records to determine if privacy violations or other infractions have been committed.

Spyder Enterprises will cooperate with authorities in investigating claims of illegal activity, including, but not limited to illegal transfer of copyrighted materials, posting or e-mail containing threats of violence or other criminal activity.

Spyder Enterprises makes no guarantee and assumes no responsibility for the security of any data contained on or passing through our systems and servers. This includes "secure servers".

Spyder Enterprises makes no guarantee to the survivability or the availability of our or our subscribers data places on any of our system. We backup our machines on a regular basis but the subscriber is responsible for have backup copies of all of there data or programs.

Subscribers are reminded that no computer system can be considered safe from intrusion. E-mail may pass through many computer systems before reaching its intended recipient and should not be considered secure. A word to the wise - Do not put anything in E-mail that you would not want to see in the editorial section of the local newspaper.
